land not maintained CLAIM FOR £225 DAMAGES From Our Oton Correspondent HAMILTON, Today. Jacob Barnett Kravis, farmer, of Rotorua, was defendant in a claim by jesse Twiner, farmer, of Rotorua, for £225 for alleged breach of agreement. The case was heard in the Supreme Court at Hamilton before Mr. Justice Ostler today. According to the statement of claim, plaintiff, in September, 1925, leased to defendant and Roy McDermott for a term of three years, a dairy farm of 101 acres at Rotorua. Defendant. during this term, failed or neglected to the land free from noxious weeds as required by a clause in the lease. Defendant had also failed to maintain all fences, drains, cates, bridges and buildings, and the milking machine. In good substantial repair, and had failed to topdress and harrow the pastures. Plaintiff alleged that defendant had not cultivated the land in a husbandlike manner and had not, at the end of the term, yielded up the land and premises in a state of good repair with all pastures in good heart, and topdressed, as provided for by the lease. 'The defence was a general denial of all allegations made by plaintiff. It was held that the property was in better condition when handed back than when leased. (Proceeding.)
