CONTRACTOR’S CLAIM
ALTERATIONS TO SHOP An unsuccessful effort was made last evening to settle the Supreme Court action in which Thos. Holdsworth, Ltd., shop fitting contractors (Mr. Bagnall) is suing Philip Schneideman (Mr. Singer) for £474 for alterations to the interior fittings of the Queen Street clothing shop in Palmerston Buildings. The case proceeded before Mr Justice Herdman today. It was claimed that the original contract price for the work was £372, that the alterations should be completed by September 5. and that exclusive possession of the shop was to be given to the workmen on September 4 and 5. It was alleged, however, that possession was not granted, and on this account plaintiff had to employ his men overtime The cost at first was £372, but subsequent additional alterations brought the amount to £469. The evidence for plaintiff occupied the whole of yesterday, and this morning the defence was presented, evidence being offered to show that a contract was entered into by plaintiff to complete the whole of the work for £372, and that the alterations had not been carried out as arranged or within the specified time.
