DRIVER TO BE TRIED

MOUNT ALBERT CASE Pleading not guilty to a charge of driving a car negligently to cause the death of Henry Haskett, Frederick’ Ernest Vogwill yesterday afternoon was committee to the Supreme Court for trial. Bail of ‘ £SO was allowed. At the inquest held jointly with the hearing of the charge, Mr. F. K. Hunt, 5.1V1.. returned a. verdict that Mr. liaskett died from shock and other in—juries, as a. result of being struck by a car driven by Vogwill. Detective McWhirter produced a statement in which Vogwill said he was travelling at 15 miles an hour along Mount Albert Road toward the intersection of Allendale Road, where the accident took place. He did not sound the horn when he approached the crossing. The windscreen was damp and blurred so he kept looking out over the right-hand door of the car. Just as he was passing the crossing he saw a. man on the road alongside the car, and he swerved toward the centre of the road. i Vogwill thought he had missed the 3man but he heard and felt a bump. Leaving the car, accused returned and found a. man unconscious. On inves—tigation he found the lights were not burning, but they had been going when he left his home. They had been dull for a. week or more but were fairly good on a dark road. The foot brake, accused said, was strong enough to stop the car, but the hand brake was out of use.
