CLAIM FOR £679

CONTRACTOR DISPUTES ACCOUNT The sum of £679 in an account of £15,000 was in dispute in a civil action heard by Mr. Justice Ostler in the Supreme Court today. John Burns amd Co.. Ltd., sued Colin Campbell Me Liver, a plumbing contractor, for £679, representing the balance of the account. Mr. Fiddes. on defendant's behalf, claimed that the account should be referred to the registrar. McLiver could not defend his objection to paying the amount until details were supplied, but requests for this data, or alternatively to search the firm’s books, has been refused. McLiver’s account had been opened in 1920, stated Mr. Reed, but had not been balanced since 1921. Interest had been charged quarterly on the outstanding balance since December, 1924. The firm had forwarded monthly accounts to McLiver, who had never questioned their accuracy until March. After hearing argument, his Honour said particulars could be supplied upon payment of £3OO into Court. This condition was not accepted, and hearing of evidence proceeded.
