WIDOW’S CLAIM AGAINST MOTORIST FAILS MAN LYING IN ROAD Press Association WELLINGTON, Thursday. The claim made against George Mitchell, company manager, of Wellington, for £1,500 damages, arising from the death of Percy Barker Phipson, a brewer of Wellington, was concluded in the Supreme Court today. The jury found that Mitchell was not the cause of the injuries which resulted in Phipson’s death, and returned a verdict for defendant. Phipson was struck by a car, driven by Mitchell, on the night of March 7, and -the claim for damages was made by the widow, through her son. Phipson was head brewer to the New Zealand Breweries, drawing a salary of £1,250 a year. Counsel for the defence said it might he contended that deceased was lying on the road when the car ran into him. Mitchell, in evidence, denied negligence. He said the first he knew of anything untoward was when he felt a bump. The visibility at the time was exceptionally bad and he was only travelling at four miles an hour round the corner. In his opinion deceased was lying on the road, having fallen.
