DAMAGES FOR SLANDER
SEQUEL TO GAME OF HAZARDS MAGISTRATE’S JUDGMENT Press Association WELLINGTON, Today. Reserved decision was given today by Mr. T. B. McNeil, S.M., in the case in which William Tressider, a watersider, claimed £IOO damages from John Barrett, one-time manager of the Courtenay Club, alleging that defendant had accused him of robbing a young man, Fitzmaurice, by using a loaded dice in a game of hazards at the club. The magistrate found that a case of defamation had been established. With regard to the defence that the action could not lie as the alleged slander arose out of participation in an illegal act, namely, in playing a game of hazards, Mr. McNeil said that former cases showed that, even if a man had taken part in an illegal transaction, he was not to he deprived of all protection in other matters connected with the transaction. Damages for £ls were awarded.
