SEQUEL TO COLLISION
DANGEROUS DRIVING CHARGE DISMISSED SMASH NOT WITNESSED "There are accidents in which the degree of negligence varies from an error of judgment up to gross carelessness/' said Mr. F. H. Levien, S.M., in the Onehunga Police Court yesterday, when Charlette Ginders, of Carlton Gore Road, appeared on a charge of dangerously driving a motor-car. evidence disclosed that on April 7 she was driving along the Manukau Hoad toward tho city, and after passing the Royal Oak at a steady pace she attempted to turn to the right at the entrance to the One Tree Hill Domain, where she collided with a motor-bicycle going toward Onehunga. The rider of the bicycle was thrown to the ground, and the machine became entangled with the near front wheel of the car, and was dragged a considerable distance inside the domain gates. Mr. T. N. Holmden appeared for the defendant, and 11 witnesses occupied the court for two hours.
Constable Wilks, who came on the scene shortly after the collision had occurred, said the engine of the motorbicycle had been forced clean out of the frame. None of the other witnesses appeared to have seen the actual collision, which caused the magistrate to remark that he had not heard one word of evidence as to how the accident occurred. There had evidently been a collision, he said, but as no evidence had been given showing a want of care on the part of the defendant, he was unable to arrive at any conclusion as to whether she was guilty of negligence. This being so, he had no option but to dismiss the charge.
