MAGPIE FOR SALE
BIRD FANCIER IN COURT ACTED IN GOOD FAITH Offering for sale an Australian magpie resulted in the appearance of J. R. Walker in the Magistrate’s Court this morning. ■jV/TR. WEST prosecuted on behalf of the Acclimatisation Society, on a charge of offering for sale and possessing a protected animal. Mr. Walker pleaded guilty, but asked leave to make an explanation. He had been importing magpies for some time, but this bird had been bought in the shop. It was just learning to speak. Mr. West pointed out that the Australian magpie was protected under the Animal Protection and Game Act, 1921. Mr. F. K. Hunt, S.M.; But surely lots of people keep these birds. Counsel was of the opinion that those who did so must have the permission of the Minister of Internal affairs. Defendant kept a bird shop in Queen Street and should know the law. “If he had even glanced at the Act he should have seen that the bird was protected,” continued Mr. West. “Horticulturists and agriculturists consider the birds do a great amount of good.” “This man bought the bird in all gQOd faith,” commented the magistrate, and ordered the imposition of costs only.
