REJECTED PROOF OF DEBT

CREDITOR’S CLAIM DISMISSED (From Our Own CorrespondentJ HAMILTON, Today. The action of the official assignee in rejecting a proof of debt was upheld by Mr. Justice Blair in an important judgment issued in Hamilton today, involving George Harry and Margaret Elizabeth Cornfoot, sheepfarmers, of Hamilton, bankrupts, and Redwood Felix Goulter, sheepfarmer, of Marlborough, a creditor. The applicant, R. F. Goulter, lodged a proof of debt in the estate of the above bankrupts, claiming £8,300 for “arrears of land tax, county rates and interest and the difference of price obtained for Spring Hill station on first and second mortgages.” The basis of the liability as stated in the proof of debt was that bankrupts were jointly liable with one Monckton. The official assignee rejected the proof and Goulter moved to the Supreme Court for an order reversing this decision. In a lengthy judgment his Honour accepted the arguments of bankrupts’ solicitors, and dismissed the motion with costs and disbursements against Goulter.
