TRAMWAY APPEAL
ALLEGED WRONGFUL DISMISSAL An appeal against his alleged wrongful dismissal from the Auckland tramway service has been made by Thomas Massicks, of 12 Chester Street, Mount Eden. It is being heard before Mr. E. C. Cutten, S.M., in the auxiliary police Court yesterday. Mr. J. J. Sullivan appeared for appellant, and Mr. J. Stanton for the Transport Board. The grounds of the appeal were that there was no cause for dismissal as appellant performed lus duties in an efficient and satisfactory manner, and that no legal reason was given for his discharge, though it was stated he did not Ullly join in all the departments of the Tramway Club. Appellant contended he did not refuse to join the club, but objected to deductions being made from his wages for certain departments of the club as he was paying for these elsewhere. It had been agreed that these payments would not be deducted. Appellant further claimed he had been dismissed without opportunity to explain the matter, and that he should not have been dismissed for claiming his wages in full; also there was no term in the agreement that lie should join the club.
