PUPUKE LAKE TROUBLE
LAKE OWNERS WANT THEIR LAND A decision to follow up the recent Supreme Court case, Mowbray v. Takapuna Borough, was reached at a meeting of the Bake Owners’ Association, held at Takapuna last evening. Mr. D. C. R. Mowbray presided. A long discussion followed on the reading of the text of the judgment of Mr. Justice Frazer in the case quoted. It was stated that competent advice had been received that lakeside owners were entitled, not only to riparian rights, but also to the land represented by the bed of the lake. It was resolved that the association make formal application to the District Band Registrar fo.r titles to the land that has accrued as the result
of the receding of the lake surface, and also for the land submerged by the waters of the lake.
Subsequent action will depend upon the nature of the reply received from the Band Registrar.
The assessors, who are, with a magistrate to form the board to consider Mr. D. R. C. Mowbray’s appeal against tho decision of the Takapuna Borough Council as to the terms in regard to roading, which it specified when approving subdivision of his land on the border of Pupuke Bake, in accordance with the judgment of the Supreme Court, have been appointed. Mr. A. Greville Walker will represent the Borough Council and Mr. X. A. Duthie tho appellant. The presiding magistrate will be selected by the Government.
