DARGAVILLE CASE HEARD SEIZURE OF LAND (Special to THE SUN) DARGAVILLE, Monday. At the Dargaville Magistrate’s Court, before Mr. F. H. Levien, S.M., Charles McAllister, settler, of Waimatenui, sued the Hobson County Council for £292 for compensation for land taken for a new road deviation, and for alleged damages to the remaining portion of his farm. Claimant said that in 1925-26, when the question of the taking of the road by the council arose, he objected. He asked for £350. This was not acceptable to the council, which subsequently took the land under the Public Work's Act, by proclamation. Evidence was given by several witnesses as to the value of the land taken, and also as to the effect of the deviation on the property. The Court awarded compensation for the road taken a=t the rate of £lO an ? acre, £43 Is. The sum of £72 was awarded under the heading of severance. On the question of costs claimant was ordered to pay £4O, our of which the assessors’ fees of £ls 15s each are to be paid, and the balance of £8 10s to be applied by the defendant council toward payment of its costs.
