CLAIM FOR COMMISSION
SUIT BY SALESMAN A suit for £306 commission, said to be due to him from Buckley, Ltd., builders, Queen Street, was brought before Mr. Justice Frazer in the Supreme Court yesterday by John Leslie Hannah, sales manager, of Auckland. Mr. Beckerleg appeared for plaintiff and Mr. Munro for defendant. In evidence, plaintiff said he was appointed in November, 1927, at £4 a week. He was to receive £ 1 a week for three months as an advance against commission. He was to receive 1 per cent, on all contracts that came into the office. His appointment dated from November 9, 1927. On May 10, 1928, Mr. T. F. Buckley, a director, gave him notice of dismissal, t stating that witness had given every satisfaction and that they were losing a valuable man. The dismissal was the action of the other director, T. C. Webster, who, however, would secure witness another position. He reminded the directors that he had been given the job for as long as he liked and sought compensation for short notice. The defence was that plaintiff was not entitled to receive commission on work done for the directors or their friends in securing which Hanna expended no efforts. After hearing considerable evidence his Honour gave judgment for plaintiff, the amount to be settled later.
