WILL OF A PIONEER
BAY OF ISLANDS PROPERTY
PROBLEM FOR THE COURT
Interpretation of the will of an early pioneer of the Bay of Islands occupied louv counsel and Mr. Justice Blair in the Supreme Court yesterday.
The action arose out of an originating summons in connection with the will of Elizabeth Marsden Bedggood, late of Keri Keri, Bay of Islands. Mr. J. B. Johnston appeared for the Piiblic Trustee, as trustee, and Mr. Northcroft for that office In its capacity as administrator of the estate of Marie King. foster-daughter of the testatrix. Mr. Cocker represented the St. John’s College Trust Board, and Mr West for residuary legatees. Mr Johnston said that deceased’s will, dated March, 1922, provided that all her property at Springbank, Keri Keri be converted and the net proceeds handed to the St. John’s College Trust Board, with the exception of tin as a legacy to Marie King. But the property was disposed of by the deceased during her life-time. It realised £BOO. Of this sum £l5O was paid in cash and the balance secured bv a mortgage given by the purchaser. The £l5O. or an approximate sum, was paid by Mrs. Bedggood into a post cliiee account, upon which she operated. At the time of her death in 1928 there was a credit of £9O. The problem of the Court was whether the sale of the property bydeceased during her life had caused the legacies to fail. After hearing legal argument, .his Honour reserved decision.
