STRUCK BY NAIL WORKER SEEKS COMPENSATION Struck in the right eye by a flying nail he was hammering in the stove or* Radley and Co., Ltd., in October. 1927, Michael Holler sought compensation in tho Arbitration Court this morning. Mr. Sullivan appeared for plaintiff, and Mr. Northcroft for Radley and Company. Holler’s eye is now covered by a traumatic cataract, which affected his sight. After evidence of Dr. Barrie had been heard, counsel agreed that an operation for removal of the cataract was desirable. Several months would, however, elapse before this could be done, and as the result was problematical to soma extent, it was further agreed to accept a suspensory award in the meantime,’ instead of attempting to arrive at a final settlement. Mr. Justice Frazer gave judgment for plaintiff at the rate of Id a week until such payments were ended, suspended, diminished or increased by further order of the Court. The explanation of this was that such a course would keep the claim alive for the full period of liability, whereas a declaration of liability would enure only for a limited period. 4 Costs and witnesses’ expenses totalling 11 guineas were allowed to plaintiff. Either party will have the right to apply for a further order after the permanent state of the plaintiff’s eye is ascertainable.
