IN AUCKLAND OR NOT?
DANGEROUS DRIVING CHARGE MOTORIST ACQUITTED Whether Frank Smith, of Katikati, who was charged at the Magistrate’s Court this morning with dangerous driving, was in Auckland on August 10, is a question which evidently has no answer. Mr. G. R. Hogan, chief traffic officer, said that he was driving along Khyber Pass Road, when a car passed him driving at an excessively dangerous speed. Witness speeded up and drew to within 10ft of the other car, and took the number. For defendant, Mr. Dyson produced statements from residents of Katikati, including the vicar, showing that both Smith and his car had been in Katikati on the day in question. “My client has been put to some expense in coming up here.” said counsel. “I think the city traffic department should pay something toward that.” Further evidence called by Mr. Hogan dissipated any doubt as to whether or not the number taken was that of Smith's car and Mr. A. J. Stratford, J.P., and Mr. R. T. Michaels, J.P., who were on the bench, said that, even if Smith’s car were not in Auckland on August 10, his number-plate was - The case was dismissed, no order for costs being made.
