JOCKEY FINED £25

INTOXICATED IN CHARGE OF MOTOR-CAR For being intoxicated in charge of a motor-car in Broadway, Newmarket* on Saturday evening, Benjamin Deeley* a jockey, aged 47, was fined £25 at the Police Court this morning. Mr. Trevor Moodie, who appeared for Deeley, said that the defendant had been one of New Zealand’s best known jockeys, but had no licence to ride at present. After going to the football match on Saturday, continued counsel, the prisoner had disposed of too much stout. When driving through Newmarket, he struck a safety zone, “which,” said counsel, “is an easy thing to do even when one is not drunk. I would ask you not to s» nd Deeley to prison,” concluded Mr, Moodie. “He has been making strenuous efforts to pull himself together lately. Probably the disappointment at not getting his licence had something to do with this lapse.” Counsel’s latter remarks were corroborated by Sub-Inspector McCarthy. “This is a difficult position.” said Mr. E. C. Cutten. S.M. “I don't want to send the prisoner to gaol as he lias dependants. On the other hand a fine may deplete his resources more than he can afford.”

On Mr. Moodie assuring the magistrate that Deeley was in a position to pay, a fine was imposed. Deeley had been convicted and fined for a similar offence some years ago.
