MIDNIGHT INTRUDER
FARMER FOUND GUILTY PLACED ON PROBATION Shortly after midnight on April 23 ! a country house at Kaeo was entered !by an intruder. A young girl sleeping in a room was awakened by some- | body placing his hands on her shoulj der. ' The incident had a sequel in the ! Supreme Court yesterday, when Heniy James Shepherd, farmer, of Whangaroa, was charged before Air. Justice Blair and a jury with breaking and entering with intent to commit a crime. He was also charged with being unlawfully on the premises. Prisoner was defended by Mr. H. Guy, of Kaikohe. M.r. V. N. Hubble prosecuted for the Crown. After 35 minutes’ retirement the Jury returned a verdict of not guilty on the first count and guilty on the second, with a strong recommendation to mercy on account of accused’s physical condition arising out of war injuries. . , •I quite agree with the decision, said his Honour. “I will give full effect to vour recommendation.” Renewal of bail was allowed, and prisoner will be sentenced to-day. ‘•I think your action was extremely foolish. I agree with the jury in exonerating you from any felonious intent,” said his* Honour, in sentencing Shepherd. , ‘ I propose to admit you to probation for two years, and you will be ordered to pay the costs of the prosecution.
