PETITION AGAINST GROCER FAILS PROTECTING CREDITORS “I do not think I ought to be satisfied with the proof of the act of bankruptcy here,” declared Mr. Justice MacGregor in the Supreme Court this morning in giving judg- ] ment on the petition to have Henry George Green, grocer, of Ponsonby Road, adjudged a bankrupt. The peitition was dismissed. “The petition against this man has I failed and £lO 10s costs will go ; against the petitioners,” added his j Honour, commenting on a request from j one of the counsel for the petitioner to I have the awarding of costs reviewed. j “The particular act of bankruptcy re- j lied on was not in any real sense com- j mitted by the debtor himself. In cases i like the present one, the court is not j dealing simply between the petition- I ing creditor and the debtor, but it is interfering with the rights of his other creditors, who, if the order is made, will not be able to sue the debtor for their amounts.” Messrs.
