JEWISH CEMETERY SITE

CONDITION OF TRANSFER LIMIT ON COMPENSATION Although at its meeting three weeks ago the City Council agreed to trans. fer the Jewish Memorial Hall site in the Karangaliape Hoad cemetery to the Hebrew community, it again had more to say on the question last evening when a clause was added to the deed of transfer requiring a condition. It was decided to allow the transfer only on condition that if the land is again required by the council and retransferred to it by negotiation or under the Public IVorks Act, no compensation shali be paid except in respect of buildings. Cr. S. I. Ci’ookes moved that the transfer be deferred until the Hebrew congregation agreed that the deed should be subject to a condition that if required by the council for any public purpose it would be retransferred in compensation for the building only. That condition was essential for the protection of the future rights of citizens, who would then not have to pay any enhanced value if the site reverted to the council at any time. Cr. J. A. C. Allum said that the Hebrew congregation had already refused such terms. At his suggestion moUon was amended by insertion of the words ’‘either by negotiation or under the Public Works Act no allowance should be made for the land, exclusive of buildings.” The amended motion was carried with several dissentients.
