NORTH ROAD COLLISION

SEQUEL IN COURT CLAIMS FOR DAMAGES A collision between two motor-cars in Great North Road on the evening of September 18 was the subject of a civil action heard before Mr. Justice McGregor and a jury of four at the Supreme Court this morning. The plaintiff- was Alfred Herman Gyllies, accountant, of Auckland (Mr. G. P. Finlay), who claimed the sum of £199 from Boucher Hill (Mr. Glaister), a clerk, of Grey Lynn, who counter-claimed for the same amount. Outlining the case for plaintiff, Mr. Finlay contended that the fact that Gyllie’s car had stopped immediately showed that he was travelling at a normal pace. It was alleged that defendant, who was travelling- from the city, turned into Beaconsfield Street without giving sufficieht notice of his intention and had turned into the side street at a dangerous angle. For the defence it was denied that there had been negligence. It was claimed that Hill, after indicating his intention to cross the main road to Beaconsfield Street, did so at a slow pace, and at a safe angle. It was claimed that the plaintiff had been travelling at an excessive speed and that defendant’s car was turning to cross the road until it was too late to stop his own car. The claim was for £133. the cost of repairs, £6 for taxi hire, £SO for depreciation, and £lO for general damages. The counter claim was for £124 for repairs, £SO for depreciation, and £25 for general damages. (Proceeding.)
