CLAIM FOR DAMAGES
SEQUEL TO COLLISION (From Our Own Correspondent) TE KUITI, To-day. An action was hoard in the Magistrate’s Court, Te Kuiti, before Mr. J. FI. Luxford, S.M., in which Emma Lena Buckman, of Pio Pio (Mr. Mackersey), claimed from Frank E. G. Seon (Mr. I. J. Goldstine), of 23 Grenfell Road, Epsom, Auckland, the sum of the £250 general damages and £l3 13s special damages for injuries received as the result of a motor collision on the Pio-Pio-Te Kuiti road on December 24 last. Plaintiff said she was being driven into Te Kuiti by her son, when the collision occurred on a bend in the road. As a result of the impact plaintiff was thrown on to the windscreen and her lower front teeth were severely injured, and her mouth and right knee were bruised. Defendant’s car, travelling on the wrong side of the road, came upon them suddenly and a head-on collision occurred. Corroborative evidence was given by the driver of plaintiff’s car, and other witnesses. Defendant said he had been driving since 1918, and had never had an accident before. Describing the accident defendant said that just prior to the collision he had given way to a service car, dropped into second gear, and commenced to ascend an incline on his correct side. When he first saw plaintiff’s car it was about 90ft. away, and it was travelling at an excessive speed. After hearing other witnesses for the defence the magistrate gave judgment for plaintiff for £3B and costs.
