ANOMALY IN AWARD
“FRONT OF HOUSE" WORKERS
Owing to an anomaly in the “front of house” theatre employees' award, an unusual position has arisen.
This was dealt with in an opinion delivered by Mr. Justice Frazer this morning. Two sub-clauses relating to continuous picture shows should be read side by side. The first provides that a continuous picture show is to be regarded as a night show, for which a performance rate of 4s a performance is payable, in so far as employees engaged “at night and for one matinee” are concerned. The other fixes a weekly rate of 25s for employees at continuous picture shows who are engaged “at night only,” but does not provide that in so far as those employees are concerned the continuous picture show is to be regarded as a night show. In the case which came before the court, the employee who worked one night or three nights a week was entitled to a wage of 25s a week, and sh could have been required to work on six nights for the same wage. Conversely, if she had been required to work on one night and one afternoon she would have been entitled to only Bs.
