SHIPPING COMPANY SUED BY PAINTER
CLAIM FOR COMPENSATION In the Arbitration Court- this morning before Mr. Justice Frazer, Harry Bresand claimed compensation from the Northern Steamship Company, Ltd. Plaintiff was employed by defendant as a painter, and when painting the s.s. Rangitoto in Calliope Dock on December 6, 1926, he alleged that he was compelled to continue working in heavy rain and with his clothing saturated. It was claimed by Mr. T. J. Fleming, for plaintiff, that as a result of this exposure Bresand had developed muscular rheumatism of a particularly painful type, and that his condition had been aggravated by working for defendant in painting the s.s. Arapawa at Onehunga, when it was necessary for him to stand in several inches of mud. Plaintiff claimed compensation of £8 8s for time lost, and such further relief as he might be entitled to, medical expenses and costs. For the defence, Mr. Cocker submitted that, as there was no accident, there were no grounds for a claim. Any incapacity in the case was the result of. natural conditions and defendant was under no obligation. Decision was reserved.
