CLAIM BY A UNION

NON-UNIONIST EMPLOYED ACTION AGAINST COMPANY (From Our Otcn Gorrcaponde', A) HAMILTON, To-day. A claim to recover a penalty of £lO for an alleged breach of the Plumbers’ and Gasfitters’ Award was made by the Auckland Plumbers’ and Gasfitters’ Union (Mr. W. R. Tuck) against the Hamilton Hardware Co., Ltd. (Mr. W. J. King), in the Hamilton Magistrate's Court before Mr. F. W. Platts, S.M., on Tuesday. Evidence was given that on January 26, 1925, the union requested the defendant company to dismiss a plumber named Robert Reginald Hollinger. who had resigned his membership in the union, the union stating that it had members equally qualified as Hollinger, who were ready and willing to undertake his .work. Mr. King said Hollinger had resigned because he was refused a rebate on his subscription. It would have been inequitable for the company to dismiss Hollinger, who had been in their employ for seven years, and was regarded as a specialist in certain branches of his trade. Mr. Tuck said the defendant company took no steps to inspect the union’s employment, book to see rf there were suitable unionists available to take Hollinger’s place, and that the onus rested on it to do so. The magistrate reserved his decision.
