The United States Supreme Court has upheld the flexible tariff provision of the Fordney-McCumber Act under which Congress approved a policy of enacting a protective tariff legislation for the purpose of fostering domestic, industries. The provision in question allows the President, upon the recommendation of the Tariff Commission, to raise or lower duties by 50 per cent, in order to equalise the cost of production at home with that in foreign countries. — A. and N.Z.
