ENTITLED TO COMMISSION
AGENT AND LAND DEAL Press Association WELLINGTON, Friday. An interesting judgment was given to-day by Mr. E. Page, S.M., in respect of a land agent’s commission. The Public Trustee claimed to recover £56 10s from R. B. T. Richardson, who had effected the sale of a property in Wellington Terrace. He accepted the deposit and, after deducting his commission, forwarded the balance to the Public Trustee, who-was administering the estate. The purchaser discovered, however, that a material fact had not been disclosed. The deposit was returned and it was agreed that the sale was off. The Public Trustee then sought to recover the commission from Richardson.
Mr. Page held that the agent did all that was required of him and was entitled to retain his commission. It was because of the failure of the plaintiff to make good his title that the deal failed.
