COMMISSION CLAIMED

AGENT’S APPEAL FAILS (Special to THE SUN.) WELLINGTON, Monday. The Chief Justice, Sir Charles Skerrett, dismissed to-day an appeal from the decision of Mr. J. H. Salmon, S.M., who gave judgment in favour of Thomas Bennett and S. S. Paget in an action brought in the Magistrate’s Court by the Progressive Agency, which claimed £ll2 10s for commission on the sal-e of property. A contract was signed, but owing to the deposit not being paid it was rescinded. It was claimed by the agency that all had been done to entitle the agency to commission. The magistrate rejected that contention, and held that the appellant had not done all he was bound to do in order to entitle him to require payment of commission.
