CASE GOES TO JURY

COUNSEL’S APPEAL IN MURDER CHARGE

DEATH OF GRAZIER

By Cable.—Press Association. — Copyright. SYDNEY, Frida. .

The trial of the brothers Hubert, William and Brucv Higgs, in connection with the murdr” of Ronald Leslie, a grazier, of Manly, was continued today. William Higgs is charged with murder, and the charges against his brothers are of being accessories afte * the fact. The case for the Crown has concluded. It 'epended upon circumstantial evidence only. Counsel for the defence argued that from the br~*nning to e 1 of the case there had been no suggestion of motiVe for the crime. The Higgs brothers had never heard of Leslie, nor Leslie of them. It was difficult to surmise what possible theory the Crown could put forward to connect these young men with the crime. Counsel submitted it was a much more reasonable theory that someone attempted to rob Leslie, who was known to possess a large sum of money. All the facts were compatible with a reasonable theory of innocence, and the case should not be left to the jury. The Judge ruled tlia. it was a case fit for the jury’s consideration, and he would not be justified in taking the case away from them.—A. and N.Z.
