ACTION AGAINST MINERS
STOP-WORK MEETINGS
(From Our Oven Correspondent) HAMILTON, To-day. Nir. Wyvern Wilson, S.M.. yesterday gave his reserved judgment in the case of the Pukemiro Collieries Ltd. against theft Pukemiro Coal Mine Workers* Industrial Union in which a claim was ma<Je for .£2OO for alleged breach of agreement for holding two stop-work meetings.
die case for the company was that it had been working its coal mine at Pukemiro under an agreement made with the union on behalf of the members of the union who were employed in the mine. The agreement was dated July 21. 1926. The company relied on subsection 4 of section 8 of the Labour Disputes Investigation Act, 1913, in its claim that the union had rendered itself liable for the payment of penalties.
Mr. P. J. O’Regan, counsel for the union, asked for a non-suit on the ground that the agreement in question had not been filed with the Clerk of Awards, and therefore the sections on xvhfch the plaintiff company relied had no application. For the defence it was contended that the defendant union had ceased to exist, and was not therefore a society within the scope of the Act of 1913. .After reviewing the evidence and quoting the law at some length. Mr. "Wilson accepted the contention of the defence and non-suited the company.
