JUDGMENT AGAINST BANKRUPT SOUGHT
ONLY SD IN £1 PAID Matthew Henderson, a bankrupt contractor, of Putaruru, faced his creditors this morning at a special meeting presided over by Mr. A. N. Hay, in the absence of the official assignee, Mr. G. N. Morris. At the previous meeting held at Putaruru a resolution was passed instructing the official assignee to facilitate bankrupt’s discharge. Since then the disposal of the assets had realised only £B9. Against this the totcil debts were £1,652, showing a dividend of only fivepence in the £. The chairman explained that several creditors had expresesd dissatisfaction with the meagre dividend, and wished now to oppose Henderson’s discharge. A creditor said that it seemed strange that six months had passed, and no action had been taken until bankrupt had applied for his discharge!. It seemed unjust to impede his freedom in that way. Bankrupt was further examined respecting his losses on a Rotorua contract, and concerning bills of sale he had given over some of his assets. A motion to confirm the resolution of the Putaruru meeting, facilitating Henderson’s discharge, was lost in favour of an amendment that debtor’s discharge be facilitated subject to his agreeing to a Supreme Court judgment against him for 5s in the £ on the amount of his debts.
This resolution will be put before the court at its sitting next Friday.
