NO MISREPRESENTATION
SHIPPING COMPANY CASE VERDICT FOR DEFENDANT Allegations that he was induced to apply for shares through misrepresentation were made by John Ley don (Mr. G. P. Finlay) against the Northern Wairoa Steamship Company, Ltd. (Mr. Greville), who claimed for the removal °f his name from the share register and the return of his money. In giving judgment in the action yesterday, Mr. Justice Stringer said the alleged misrepresentation of the financial soundness of the company failed as did the allegations of misrepresentation as to the memorandum and articles of association. The capital which had been subscribed was intact except in so far as it had been reduced by legitimate expenditure. The plaintiff therefore failed in his claim and judgment would be for the defendant. “Having regard to the loose and irregular manner in which the business of the company has been conducted,” concluded his Honour, “I make no order for costs.”
