DAMAGES ACTION FAILS

SAID HE FELL ON SAND HEAP The reserved decision of Mr. W. R. McKean, S.M., was given in the Magistrate’s Court this morning in the action brought by E. E. Sutherland (Mr. J. J. Sullivan) against L. G. Watson (Mr. Terry), for £3l 5s in respect of alleged injuries received by falling over an unlighted heap of sand which the plaintiff alleged was left on the footpath near his house. The plaintiff was non-suited and costs amounting to £6 19s 6d were allowed to defendant. The defence denied that the sand was left on the footpath, but stated that when the sand was delivered it was shovelled off by workmen. The magistrate held that the plaintiff had failed to establish how his injury was caused. The evidence was not sufficient to prove that the sand was in fact on the footpath.
