DAMAGES FOR HORSEMAN
CRUSHED BY MOTOR BUS A total of £ 490 damages was awarded plaintiff by the jury in a claim for £1,004 heard before Mr. Justice Herdman in the Supreme Court yesterday. Joseph James Hoe, farmer (Mr. G. P. Finlay) sued W. J. Wheeler and Sons, bus proprietors (Mr. Northcroft), claiming damages for injuries received through being crushed by the defendant’s bus and the subsequent destruction of his horse. Plaintiff was riding to Paerata on the night of Decer | >er 22, and, hearing the bus approacning as he reached a bend in the road, drew close to the bank. The bus, however, came at him and crushed him and the horse against the bank. His honour said it was not a case for heavy damages. The jury had no right to punish the defendant company, and was bound to award reasonable damages only.
