PUBLICAN’S PROMISE STUDENTS IN COURT (.Special to THE SUX. ) CHRISTCHURCH, Wednesday. In the excitement and enthusiasm of the moment, just before a football match at Lincoln College recently, Henry James Lack, licensee of a hotel at Lincoln, promised a member of the College team a bottle of wine if the team won. The student left it rather late, and it was round about 8 p.m. when he arrived at the hotel with three friends to get the bottle. It was about the same time that Constable Smither arrived. Before Air. H. P. Lawry, S.M., this morning, Lack was charged with opening his hotel for sale after hours, exposing liquor for sale after hours, selling liquor after hours, and selling liquor to persons apparently under the age of 21. He pleaded guilty to the first two charges, and not guilty to the others. Mr. R. W. Olliver appeared for Lack. Constable Smither, of Lincoln, said that he visited the hotel on the Sat - urday evening in question. There were four young men in the passage bar. The slide was open and there were four glasses on the slide. All the young men were Linder 21. The witness charged them with having gone to a hotel for a drink. The four students, Henry Frank Seymour, aged 18; John H. Upton, 19; William AlcLeay Innes, 19; and John Sutton, each gave evidence admitting having been foLind on the premises. They were each ordered to pay costs, for being on licensed premises after hours. As far as the ages of the boys went Lack said that he had only seen Upton when they arrived, and Upton might be taken for well over 21. The magistrate fined Lack £7 and costs for selling to persons under 21, holding that the licensee must have had ample opportunity to see the four students and judge their ages. For opening after hours Lack was fined £1 and costs, and on the charge of exposing for sale after hours lie was convicted and discharged. The other charge was dismissed.
