NATIVES BEFORE COURT CONFLICTING EVIDENCE (From Our Oxen Correspondent.) HAMILTON, To-day. A Maori named Honu Marino was before the court at Rotorua yesterday on a charge of spearing trout. Two rangers testified to seeing natives chasing the fish in thes Wainohe Stream, and considered Marino was one of them. In defence, Marino swore that he was at home all the day in question painting his house, and this statement was borne out by his wife, mother, and another native. The court was strongly of opinion that there was ruthless butchery of trout during the spawning season in existence to a marked extent. A laudable effort on the part of the department was being made to restore Rotorua’s prestige as a fishing resort, and success was impossible without the wholehearted co-operation of the public. However, in the case under review, a reasonable doubt existed as to the identity of defendant, and he was entitled to the benefit of the doubt.

The case was therefore dismissed each party to pay its own costs.
