A POINT IN DIVORCE

A divorce case was adjourned at the Hamilton Supreme Court yesterday in order that the judge could decide the question of jurisdiction on the novel point as to whether a divorce could be granted where the parties were not domiciled in the Dominion, although when the petition was lodged and evidence taken, the petitioner was living in Hamilton.

The proceedings were those in an elderly man, Thomas Elwell. petitioned for a divorce from Emily Grace Harford Elwell, on the ground of separation. The parties had been married 47 years, but a dispute which arose over a family matter when they had been married 20 years caused them to part company.
