PROPERTY CONTRACT
£40,000 INVOLVED WELLINGTON ACTION Press Association. WfiILLINGTON, To-day. An action for the enforcement of a contract relating to the«sale of the Trocadero Hotel on Lambton Quay, for £40,000 came before Mr. Justice Alpers in the Supreme Court to-day. The plaintiffs were the Public Trustee, sole executor under the will of Hamilton Gilmer, and executortrustee under the will of Allen Maguire, His Honour Chief Justice Skerrett, Mary Ann McArdle, and John O'Kane, executors and trustees under the will of Owen McArdle. The defendant was Robert Duncan Benjamin, a builder, of Christchurch. The plaintiffs claimed that the defendant protracted to buy the property. They had applied to defendant to perform the agrement. They were still ready to perform it on their part, because through defendant's failure to perform it they had been caused a serious loss and expense. They asked the court to order a specific performance, otherwise £1,500 damages, and £750 special damages. The defence is a false representation in regard to the property.
