Partner Loses Faith
FORMATION OF COMPANY INVESTMENT CLAIM FAILS “What plaintiff in reality seeks is a refund of the money he put into the undertaking because he has lost faith in it. I do not see how he can get judgment for that,” said Mr. E. C. Cutten, S.M., yesterday, in giving judgment for the defendants at the Magistrate’s Court. The judgment concerned a claim by W. G. Speer (Mr. Hume) for the return of an investment of £SO in a partnership with the defendants, H. W. de Baugh (Mr. Prendergast) and W. S. Alderson (Mr. Thwaites). During the negotiations for the formation of the company, it was said, Speer became dissatisfied and refused to take shares in it. The others offered to assign him his proportion of shares and also to pay him £SO for his interest at the end of six months.
