CLAIM AGAINST CITY COUNCIL
MAN SEEKS RETURN OF RATES ALLEGEDLY PAID BY MISTAKE that the sum of £6S had been paid to the defendants (the Auckland City Council) under a mistake of fact, Thomas Julian proceeded against the corporation yesterday for the recovery of the money. The case was heard before Mr. Justice Skerrett, Chief Justice. Mr. J. H. Luxford appeared for the plaintiff and Mr. A. H. Johnston for the Auckland City Council. It was stated that the amount of £6B had been paid to the council as rates in connection with buildings known as Chancery Buildings, situated at the corner of Connell Street and Chancery Lane, and of which plaintiff was a part owner. Counsel stated that the building had been completed after the rates had been declared for last year and that the council had sought to recover rates for the whole period. Not knowing that the council did not have the power to claim for the broken period, plaintiff had paid the amount in question, also not knowing that litigation between the other occupiers of the building and the council was pending in the matter. After hearing lengthy legal argument of a technical nature. His Honour reserved judgment.
