A PRISON ESCAPEE

CAN COUNSEL APPEAR? AN INTERESTING POINT (From Our Resident Correspondent .) WELLINGTON, Saturday. A peculiar point was raised in court to-day, when Mr. Leicester, who appeared for a prison escapee, expressed doubt whether he could appear for his client on a charge of prisonbreaking. Magistrate Page: Why not? Mr. Leicester: That is how I am instructed. I will appear for him on the other charge, however. Detective-Sergeant Holmes said it was represented to him that an escaped prisoner was deprived of his civil rights, and that counsel could not therefore appear for him.’ Mr. Leicester: I received instructions to visit the prisoner at the gaol, but I was told I was not allowed to see him. The prison authorities said counsel had no rights on account of the prisoner having escaped from gaol. I was allowed to see him on the other charges, however. They said this matter was dealt with by internal regulations. The Magistrate: But he is nowcharged with an offence against the Police Offences Act. Counsel was then allowed to handle the case generally.
