LEGAL FORMALITY
MUST BE OBSERVED CHIEF JUSTICE’S RULING At the Supreme Court this morning the Chief Justice, Sir Charles Skerrett, said that he wished it made clear that every legal formality in connection with the Bankruptcy Act must bo strictly complied with. The case was one in which an application for the adjudication of a Te Puke farmer, Charles Alexander Maunder, was made by Mr. S R. Mason, and where applicaticn for the substitution of petitioning creditors was also lodged.
His Honour said that sufficient time had not elapsed between the formal notification of substitution and the present application.
It was pointed out by Mr. Mason that unless an adjudication was made now it would not be possible for the Public Trustee as petitioning creditor to investigate the circumstances of a sale of goods and stock which had taken place. The application was granted.
