FATAL NEGLIGENCE
YOUNG DRIVER SENTENCED TERM IN THE BORSTAL Press Association DUNEDIN, To-day. Ashley George Faigan (20) was sentenced by the Supreme Court on charges of manslaughter and negligent driving. A. peedstrian was knocked down by the motor-car and killed. In connection with this charge, a point of law was submitted by counsel during the hearing in regard to the culpability of an unlicensed driver, and sereved for the Court of Appeal.
Mr. Justice Reed said there was too much reckless driving, and the Court could not pass over the cases. If it did, then there would be no example and no deterrent. Accused was ordered to be detained in the Borstal Institution for three months, and disqualified from obtaining a motor driver’s licence for three years.
The Judge added that the sentence was on the second charge. On the first charge sentence was postponed till the question reserved for the Court of Appeal was settled. Its decision would be referred to him, and he would not increase accused’s punishment.
