STRATFORD MAGISTRATE'S COURT.

WIN FOR THE TENANT. The taking of evidence in the case of Mary Forbes v. Charles Benjamin Gollop was concluded in the Stratford .Magistrate’s Court yesterday, before Mr W. C. Kenrick, S.M. Mr T. C. Fookes (who appeared for defendant) continued the cross-exam-ination of Albert Forbes, who said there was no entry in his rent book about the reduction of the rent. He sold the house for his wife. He denied saying it would be necessary to make a concession to defendant owing to their going out. By Mr P. Thomson: We had no acceptance of the terms in the note left at defendant’s. The papering agreed upon was not done during the tenancy, but defendant had continued to pay 15s per week. This closedthe case for the plaint’ll The only witness for the defence called in Stratford was Joseph Henry Thompson, who said he acted as agent for Mr and Mrs Forbes in the sale of the property. Shortly before the sale was made he went down to Forbes’ farm and had an interview with Mrs Forbes, and they gave him the opinion that negotiations were being entered into with defendant to arrange for a six months’ tenancy at a rental of 14s per week. He informed Mr Forbes that the purchaser required the house at once, and made a suggestion that a concession be made to defendant. Mr Forbes said that they would have to make a concession if defendant went out right away. By Mr P. Thompson: The interview took place about the 16th October. Possession was to be given in a month’s time after the signing of the agreement by purchaser. Judgment was given for defendant for the amount of the claim (£2), and costs £1 Hs.
