j William Incledon, dairyman, was today fined £2O and costs on a charge of selling adulterated milk containing 25 per cent, of added water, and artificially colored with annntto. Evidence for the prosecution was heard in April last, and for the defence Mr Myers raised the technical point that the Department could not prosecute because the milk was not sold to the inspector. This was uphold and the case dismissed.

Against this decision the Crown appealed to the Supreme Court, and the appeal was upheld, and the case accoruugiy remitted to the magistrate. Counsel for the prosecution asked that an order be made, as provided by the Act, directing that the defendant's name and place of business published in t lie newspapers. Mr Myers objected to such an attempt to nthi a man's business: after such a long period had elapsed.?

His Worship said lie did not propose to make such an order, believing that a substantia] line would meet the case. Tlie analysis showed that an abundance of water had been mixed with the milk, and if defendant did not pin 'o it there himself he was responsible for the acts of his servants.

Mr Myers,: It may have been the supplier who was at fault.

His Worship: Then defendant should tost the milk before lie sells it.

LETTER CARRIER'S LAPSE.

Ashbnrfon, March 11. At the Police Court to-day Reginald James, a youth of 18 years, and a former employee of the post office, was chargod with having between February and March, 191.3, at Ashburton, contrary to his duty, opened four letters, and with having on various dates in February and March, 1913. secreted 131 postal packets. In evidence it was stated that the letters were discovered l>e.loath the floor-boards of an old building in which accused formerly resided, and which was now being demolished. James pleaded, guilty, and was committed to appear at the Supreme Court at Timaru for sentence, bail being allowed.
