Mr Justice Chapman delivered judgement to-day ill an appeal by the police against the Magistrate’s decision dismissing a charge of permitting drunkenness against Christopher Jansen, the licensee of the Wellington Hotel. Jansen was away at the time, and it was held by the' magistrate that lie was not responsible for wrongful acts on the part of In's barman. In giving his judgment. His Honor took tin opposite view, and hold tint the nublican’s authority had boon delegated to tin 1 barman, lie upheld the appeal. a”d remitted the case to the magistrate.
