Acting on behalf of himself and other preference shareholders of the Commercial Bank of Australasia, Mr George Marshall sought a declaration and injunction to restrain the Bank fulfilling its announced intention of paying ordinary shareholders a dividend of ten per cent.- without first providing for tile restoration of lost preference capital. Judgment, with costs, was given for defendant Bank.
