ARREST OR SUMMONS.
AN UNUSUAL POSITION.

An unusual position arose in the Magistrate's Court to-day, when a young man named Joseph Bowling, arrested on warrant in Auckland, and charged with failing to provide tor the maintenance of his mother, appeared in custody. His counsel protested that his client was not legally before the Court, which had no power under the statute to arrest him. He should have boon dealt with by summons. He should bo served with a summons now and allowed to walk out of the Court.
Inspector Hendry: Yes; and take the first boat for Australia and leave his mother to die in the gutter. Magistrate Cooper: The man is hero and ivo will hold him. The warrant was issued by another Magistrate. You can't expect me to traverse his action.
The case was adjourned till to-mor-row to enable the motlier to obtain legal assistance.
