COMPENSATION FOR LAND.

A ease of spine importance to the West Coast was brought ; by . Hugh Taylor, of Inangahua Junction, before the Compensation Court, Taylor claiming £1930 as compensation for iands taken for railway purposes, for loss of sawmill site, loss of water eights, and injuriously affecting the land- During the hearing of the case, the Crown contended that claimant ivas entitled to the value of the land taken, but the Crown was entitled, as a set-off against the claim for injurious affections of the land, to the betterment, that is, the increased value to the land, by reason of the railway being brought to the district, even though the benefit was shared by other residents. His Honor (Mr Justice Dennis 1 ton):'held that the Crown must show special benefit to the claimant's land over and above that shared by his neighbours, but after further discussion His Honor agreed with counsel's contention. The Court, after a short, retirement, gave judgment for claimant for £165, claimant to pay the assessors' fees (totalling 60 guineas).
