PUBLIC SERVICE NOTICE

[Per Press Association.] Wellington, July 25,

The Gazette notifies that as the number of female applicants who have already qualified for cadetships in the Public Service very greatly exceeds the number of suitable vacancies likely to occur for them in 1913 and 1914, it has been decided not to admit any female candidate to the Public Service entrance examination of November, 1913. t This does not affect the admission of girls to, the intermediate examination for scholarships, senior free* place, and other,purpose* to be held at, the same time.

THE DEATH DUTIES ACT. Wellington, July 25. The Court of Appeal delivered its reserved judgment this morning in the case of Perry v. the Commissioner of Stamps. ' The Court unanimously held that the deed of settlement created a valid trust and as it was made without consideration it amounted to a gift within the meaning of part 4 of the Death Duties Act, 1909, and that the duty as assessed by the Commissioner was correct. The appeal was therefore dismissed, but as the point upon which the assessment was upheld was not raised by the Commissioner po costs would be allowed.

Wellington, July 25

Ju the, case (which was removed into the Couyt of Appeal) of Playle ,v. the Riversdale. Co-operative Dairy .Company, Limited, the Court (Justice Stout dissenting) held that the words complained of were defamatory and referred to the plaintiff, and that plaintiff was therefore entitled to the verdict, which was fqr £35 damages for libel obtained by him at New Plymouth. The motion on the non-suit was refused and judgment was ordered to be entered for plaintiff,with costs in the Court below as fixed by that Court, and costs on the lowest scale in the Court of Appeal.
